Sarah West Photography Contract, Terms and Conditions

1. Booking and Payment

Upon booking, the Photographer will reserve the time and date agreed upon, and will not make other reservations for that time and date. The full amount of £10 is to be paid at the time of booking to secure your Photo Shoot Package. Client agrees if the balance is not paid at the time of booking, the Photographer cannot guarantee to fulfil your Photo Shoot Package. The remaining of your photo session fee will be due on or before your session date. Purchases of Gift Certificates are non-refundable and cannot be exchanged for cash.. Expiry dates will apply.

2. Cancellation/Postponement/Refunds

Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the photo shoot session by Client, the booking fee paid is non-refundable. Booking fees are transferable once if a date change is necessary. Forty-eight hours notice of postponement is required to transfer booking fee over to another date. If a refund is required this can take between 5-10 business days to show to the original payment account.

3. Limit of Liability

In the unlikely event that the Photographer is injured, becomes too ill, or has an emergency that prevents them from carrying out the photo session booked, the Photographer will make arrangements to re-schedule the session. If a suitable day for reschedule is not agreed upon, the Client agrees that responsibility and liability of the Photographer to the Client is limited to the return of all payments received for the Photo Shoot Package. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the Photographer’s control, including but not limited to camera, hard drive, or equipment malfunction, the Photographer’s liability is limited to the return of all payments received for the photo shoot package.

4. Session Information

Please do not bring your own camera or recording equipment to the photo shoot session, if brought the photographer will have to ask that the equipment is put away. During the session, for safety reasons the client is responsible for the behaviour of themselves and their child / children. If equipment is damaged or broken due to negligent behaviour, damages will incur a fee.

5. Completion Schedule

The Client agrees that no photographs, digital or prints, will be delivered until full payment is received. Client will receive an online gallery within 2 weeks of their photo shoot session. Photographer retains the right to edit the photographs and omit any image. All images will be adjusted for skin blemishes, exposure, brightness, contrast, sharpness, etc. The Photographer's judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost.

6. Re-Shoots

Upon viewing samples of Photographer's work, you have decided to invest in photographers services, because you are confident the photographer can give you results which you will cherish. The photographer does not hold responsibility for client regret over wardrobe choice, location choice, prop choice etc. In the unlikely event that the finished product from a portrait session is unusable due to technical problems, (camera failure or exposure problems), Photographer will reshoot at no additional charge.

6. Digital Images, Prints and Copyright

The 1998 Copyright, Designs, and Patents Act assigns copyright to and remain the property of Sarah West Photography applying to all images, unless at the time of booking a release is negotiated. Client is obtaining prints for personal use only, and shall not sell prints or authorize any reproductions by parties other than Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. Sarah West Photography cannot take any responsibility for prints purchased via other companies other than ordering directly through photographer. Photographer uses a professional photography printing lab solely for photographer. Instant high street print machines will not provide the same quality printing services. Recommend high street printers are Snappy Snaps and Jessops.

7. Model Release

Client grants to Photographer and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of Client, Client’s child or children, or in which Client may be included for editorial, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Photographer and her legal representatives and assigns from all claims and liability relating to said photographs.

8. Ordering Products

Client must select products which are included in the photo shoot package purchased within 4 weeks. After this time the online viewing gallery will become unavailable. A fee of £10.00 will apply to cover the process of setting up a new online viewing gallery. Photo prints included in the photo shoot package must be chosen within 4 weeks unless prior arrangement with photographer.

9. Storage of images

Original digital images are kept on an active file for three months, after which time they will be subject to deletion without notice unless expressly stated otherwise by the Photographer.

10. Entire Agreement

This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived. This constitutes an order for one photo shoot session with Sarah West Photography.
